Terms of Service

By accessing and using BlikSpace (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.

These Terms of Service apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

We reserve the right to update and change these Terms of Service by posting updates and changes to the BlikSpace website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you.

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

Account Requirements:

• You must be 18 years or older or have parental consent to use this Service
• You must provide a valid email address and any other required information
• You may not use the Service for any illegal or unauthorized purpose
• You are responsible for all content posted and activity under your account
• One person or legal entity may not maintain more than one free account

We reserve the right to refuse service, terminate accounts, remove or edit content at our sole discretion.

Paid services are billed in advance on a monthly or annual basis and are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

Billing Policies:

• All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities
• You are responsible for paying any such taxes, levies, or duties
• Subscription fees are billed in advance on a recurring basis
• You authorize us to charge your payment method on a recurring basis
• Failed payments may result in immediate termination of service

Free trial periods, if offered, will automatically convert to paid subscriptions unless cancelled before the trial period ends. You can cancel your subscription at any time through your account settings.

You are prohibited from using the Service or its content:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international or local laws, regulations, or ordinances
• To infringe upon or violate our intellectual property rights or the rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To collect or track personal information of others without consent
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• To interfere with or circumvent security features of the Service

We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

The Service and its original content, features, and functionality are and will remain the exclusive property of BlikSpace and its licensors. The Service is protected by copyright, trademark, and other laws of Germany, the European Union, and other applicable jurisdictions. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Content:

You retain ownership of any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content in connection with the Service.

You represent and warrant that you own or have the necessary rights to use and authorize us to use all copyright, trademark, trade secret, or other proprietary rights in and to any content to enable inclusion and use of the content in the manner contemplated by the Service.

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Data Security:

While we implement security measures to protect your data, you acknowledge that no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.

You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. BLIKSPACE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability:

IN NO EVENT SHALL BLIKSPACE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

If you do not agree to the new terms, you are no longer authorized to use the Service.

Governing Law:

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
